On the second day (January 16), Atty. Mangadlao-Miolata clarified the various elements of Department Order No. 49, series of 2006, providing detailed explanations on the legal frameworks and best practices in handling administrative investigations and cases.
The session underscored the importance of ensuring integrity, fairness, and due process in the public service. โPublic office is a public trust. All public officers and employees must be accountable to the people and act with responsibility, loyalty, and integrity,โ Atty. Mangadlao-Miolata emphasized, citing Section 32 of Executive Order 292.
The discussion explored the principles of administrative due process, with particular focus on the โSeven Cardinal Requirementsโ of fair administrative proceedings. These include the right to a hearing, the requirement for substantial evidence, and the necessity for independent decision-making by investigating bodies.
Practical applications of these rules were illustrated through notable jurisprudence, including landmark cases such as Pefianco v. Moral, Gaoiran v. Alcala, and Balbastro v. Commission on Audit. These cases highlighted how procedural lapses and adherence to due process can significantly impact the outcomes of administrative decisions in public offices.
The session also addressed practical steps for handling administrative cases, classifications of offenses, and preventive suspension protocols, and the responsibilities of disciplining authorities, equipping education leaders with the knowledge to ensure transparency and justice in their respective roles.
